Pretende-se, neste artigo, inserir o leitor no universo do catolicismo popular do povo goiano a partir de suas três dimensões: o culto popular à figura de Deus Pai, que em Goiás ganha o nome de Divino Pai Eterno, na cidade de Trindade; a devoção popular à figura de Deus Filho, no culto ao Senhor Bom Jesus dos Passos, na Cidade de Goiás; e por último, no culto ao Espírito Santo, na Festa das Cavalhadas, na cidade de Pirenópolis. Na religiosidade popular (...) sagrado e profano se mesclam no cenário do cerrado goiano do Brasil Central. Na pesquisa realizada percebe-se que o povo goiano não separa sua experiência de fé das experiências do cotidiano em suas devoções populares. O povo do cerrado sabe suspender momentaneamente a dureza do dia-a-dia, mergulhar num estado de graça e dele sair revigorado para enfrentar as vicissitudes que a vida impõe a todos. O panorama religioso goiano é marcado pelas festas apresentadas nesse artigo e por outras que floreiam o calendário secular e religioso local. Palavras chave: Religiosidade popular, Divino Pai Eterno, Senhor Bom Jesus dos Passos, Festa do DivinoThis article intends to insert the reader within the universe of popular Catholicism in the state of Goiás in Brazil through three dimensions: the popular cult of God as father which is called in Goiás the Divino Pai Eterno in the city of Trindade; the devotion of the Son called Bom Jesus dos Passos in the city of Goiás and at last, the cult of Holy Spirit as it is shown in the city of Pirinópolis during a festivity known as Festa das Cavalhadas. In central region of Brazil the popular religiosity, the sacred and the profane appear mixed. This research clarifies that people does not separate their faith from their everyday experiences. People from Cerrado land knows both how to suspend temporarily the hardness of daily life and to dive into the state of grace. They come out from that experience fulfilled with the necessary energy to deal with the vicissitudes their lives impose upon them. In Goiás the religious scene is marked by the festivities described in this article along with other ones that brighten secular and religious calendar. Court rulings are among the most important documents in all legal systems. This article describes a study in which natural language processing is used for the automatic characterization of Spanish judgments that deal with the physical custody (joint or individual) of minors. The model was trained to identify a set of elements: the type of custody requested by the plaintiff, the type of custody decided on by the court, and eight of the most commonly used arguments in this type of (...) judgment. Two jurists independently annotated more than 3000 judgments, which were used to train a model based on transformers. The main difficulties encountered in this task were the complexity of the judicial language and the need to work with appellate court rulings that have a more complicated structure than decisions at first instance. For the complete court rulings, the F1 score of the inter-annotator agreement ranged from 0.60 to 0.86 and the Kappa index from 0.33 to 0.73. The F1 score of the agreement between the model and the annotators ranged from 0.66 to 0.93 and the Kappa index from 0.57 to 0.80. These results in which the model performance exceeds even the inter-annotator agreement show the high ability of transformers to identify abstract entities in legal texts. (shrink)

Este artigo tem por objetivo geral investigar, numa perspectiva foucaultiana, as relações entre governo e subjetividade, através das artes de governar e a constituição do Estado moderno. Nessa tarefa, consideramos os cursos ministrados por Foucault, Segurança, Território, População e O nascimento da biopolítica, para tratar da presença do poder pastoral na constituição da governamentalidade. O objetivo específico é investigar outras possibilidades de organização social, associados a princípios democráticos, como solidariedade e autogestão em oposição aos efeitos gerados pelo neoliberalismo, com a (...) generalização dos valores mercadológicos nas condutas individuais e coletivas. Em nossa hipótese, consideramos a perspectiva anarquista como o contraponto vital na produção de outras formas de vida social e política, para além dos princípios exclusivamente econômicos. Neste ponto, apresentamos conceitos básicos dos valores anarquistas, como a ideia autogestão, apoio mútuo, a ideia de liberdade, encontrados em Bakunin, Kropotkin e Goldman, e a possibilidade de um pensamento sobre resistências e práticas no presente conforme as reflexões de Rago. Passamos também por uma crítica ao modelo de organização social e à própria ideia de democracia, a partir dos apontamentos de Graeber em Um projeto de democracia. Por fim, nosso esforço visa refletir sobre as possibilidades de um mundo outro, a partir de uma perspectiva que se apresenta radicalmente oposta às práticas políticas e sociais que encontramos hoje. Pretendemos, portanto, pensar no tempo presente e na possibilidade de novas formas de existência. (shrink)

Este trabajo se centra en la acción dialógica y comunicativa entre las personas con la intención de mejorar su educación. Para ello se ha adaptado el formato de las tertulias literarias dialógicas al contenido de las obras musicales. Los principales objetivos han sido: desarrollar las competencias comunicativa, lingüística y musical a través del diálogo interactivo; aumentar el grado de motivación e incrementar la cultura musical de los futuros docentes hacia la música clásica. Se combina una metodología cualitativa con cuantitativa y (...) el método investigación-acción. La muestra han sido 136 estudiantes, futuros docentes en formación. The traditional ludomotor activities (LA) are recognized by UNESCO as an intangible piece of cultural heritage. The ethnomotricity analyzes LA in its sociocultural context, taking into account the proprieties of rules or motor conditions (internal logic) and the link with local culture (external logic). The aim of this research was to identify and reveal the distinctive ethnomotor features of LA in order to understand the adaptations that occurred in the social scenario of the Spanish Civil War (1936–1939) in Lleida. The (...) corpus of the research was constituted by 101 LA which were collected from the analysis of 20 semi-structured interviews. An “ad hoc” tool was designed and agreed upon by expert observers. It was comprised of a total of 27 ethnomotor variables related to LA. The experts achieved high reliability [Cohen’s kappa coefficient (κ) and Spearman’s correlation coefficient = 1] when the classification of LA was carried out on two different occasions. Descriptive statistics, cross-tabulations (Pearson’s chi-squared) effect sizes, and two-step clusters were performed by external and internal logic variables. The presence or absence of motor interaction (X2= 9.029;df= 1;p< 0.003;ES= 0.298) was enlightening when comparing LA with and without a war connotation. On the other hand, the hierarchy of variables rested primarily on IL-Domain (Psycho-Coop-Oppo-Coop/Oppo) (PI = 1). Among other singularities, while two-step cluster analysis revealed a corresponding ethnomotor silhouette with cluster 1, with the warlike connotation (n= 48; 96.0%), its homologous structure was expressed (Cluster 2) in the absence of the warlike character (n= 26; 50%). Background: Frailty is a common syndrome among older adults and patients with several comorbidities. Grip strength is a representative parameter of frailty because it is a valid indicator of current and long-term physical conditions in the general population and patients with severe mental illnesses. Physical and cognitive capacities of people with SMIs are usually impaired; however, their relationship with frailty or social functioning have not been studied to date. The current study aimed to determine if GS is a valid predictor (...) of changes in cognitive performance and social functioning in patients with type-2 diabetes mellitus and SMIs. Methods: Assessments of social functioning, cognitive performance, and GS were conducted in 30 outpatients with type 2 diabetes mellitus, 35 with major depressive disorder, 42 with bipolar disorder, 30 with schizophrenia, and 28 healthy controls, twice during 1-year, follow-up period. Descriptive analyses were conducted using a one-way analysis of variance for continuous variables and the chi-squared test for categorical variables. Differences between groups for the motor, cognitive, and social variables at T1 and T2 were assessed using a one-way analysis of covariance, with sex and age as co-variates. To test the predictive capacity of GS at baseline to explain the variance in cognitive performance and social functioning at T2, a linear regression analysis was performed. Results: Predictive relationships were found among GS when implicated with clinical, cognitive, and social variables. These relationships explained changes in cognitive performance after one year of follow-up; the variability percentage was 67.7%, in patients with type-2 diabetes mellitus and 89.1% in patients with schizophrenia. Baseline GS along with other variables, also predicted changes in social functioning in major depressive disorder, bipolar disorder, and schizophrenia, with variability percentages of 67.3, 36, and 59%, respectively. Conclusion: GS combined with other variables significantly predicted changes in cognitive performance and social functioning in people with SMIs or type-2 diabetes mellitus. Interventions aimed to improve the overall physical conditions of patients who have poor GS could be a therapeutic option that confers positive effects on cognitive performance and social functioning. El presente trabajo analiza el postmarxismo o populismo que colectivos autodenominados de izquierda han incorporado al debate político español procedente de Iberoamerica, desde la perspectiva del pensamiento de Rosa Luxemburg. En este artículo se plantea la hipótesis de que podría establecerse un paralelismo entre el reformismo, con el que Luxemburg calificó a la socialdemocracia alemana, y el discurso de actores políticos que asumen los postulados populistas. Se entiende que el populismo oculta la cuestión de clase en beneficio de ‘guerras (...) culturales’. Este artículo responde a esta pregunta afirmativamente y se estima que el populismo o postmarxismo es una herramienta que desatiende la cuestión de clase y hace inviable el cambio social. (shrink)

En este trabajo se hace un análisis hermenéutico de la obra Constitución Social de Honduras de Ramón Rosa con el fin de revelar rasgos de la identidad hondureña que subyacen en pensadores del siglo XIX en el contexto de la Reforma Liberal. Luego de introducir datos básicos del autor, de la obra y la época histórica de su redacción, se presenta y justifica el uso de un instrumento hermenéutico para analizar dicho texto. Este instrumento divide el análisis en tres (...) ejes temáticos: antropológicos, morales y políticos; posteriormente, aplicando categorías de análisis adecuadas al fenómeno de la nacionalidad en clave de modernidad, se interpretan los contenidos del texto desde los tres ejes temáticos mencionados, para extraer rasgos identitarios desde una postura filosófica. Es así como este artículo se presenta como un primer acercamiento a la conformación de la identidad hondureña a partir de un análisis hermenéutico. (shrink)

Virtue ethics has often been regarded as complementary or laissez-faire ethics in solving business problems. This paper seeks conceptual and methodological improvements by developing a virtue character scale that will enable assessment of the link between organizational level virtue and organizational performance, financial or non-financial. Based upon three theoretical assumptions, multiple studies were conducted; the content analysis of 158 Fortune Global 500 firms ethical values and a survey of 2548 customers and employees. Six dimensions of organizational virtue (Integrity, Empathy, Warmth, (...) Courage, Conscientiousness and Zeal) are identified through confirmatory factor analysis, and validated against satisfaction measure. Strategic implications of virtue characters are discussed. This paper presents an experience in developing professional ethics by an approach that integrates knowledge, teaching methodologies and assessment coherently. It has been implemented for students in both the Software Engineering and Computer Engineering degree programs of the Technical University of Madrid, in which professional ethics is studied as a part of a required course. Our contribution of this paper is a model for formative assessment that clarifies the learning goals, enhances the results, simplifies the scoring and can be replicated (...) in other contexts. A quasi-experimental study that involves many of the students of the required course has been developed. To test the effectiveness of the teaching process, the analysis of ethical dilemmas and the use of deontological codes have been integrated, and a scoring rubric has been designed. Currently, this model is also being used to develop skills related to social responsibility and sustainability for undergraduate and postgraduate students of diverse academic context. (shrink)

An undiscovered chapter in the history of architecture comes from the ex-Soviet Republic of Georgia. Poetics of Architecture is the name given to the studioworkshop at the Georgian Technical University set up by the Georgian architect Shota Bostanashvili (1948–2013). From 1990 until his death he delivered insightful, playful and rather provocative lectures on architecture at this university. He preferred to call his architectural philosophy, critical discourse on architecture. Themes ranged from poetics to metapoetics of architecture. His philosophy of architecture is (...) illustrated by some of his designs and executed projects which demonstrate a drift from existentialism to the philosophy of play. This study includes reference to his last building, a project whose demolition Bostanashvili witnessed before passing away. Based on the concept of the return of the sacred, this edifice was a sort of counter movement to technogenic architecture. (shrink)

Constitutional law in the United States is, for most practical purposes, the product of ‘judicial review’, the power of judges to disallow policy choices made by other officials or institutions of government, ostensibly because those choices are prohibited by the Constitution. This extraordinary and unprecedented power, America's dubious contribution to the science of government, has made American judges the most powerful in the world, not only legislators but super-legislators, legislators with virtually the last word. Because lawmaking power divorced from popular (...) will is tyranny, most states have attempted to reconcile the lawmaking power of judges with representative self-government by subjecting all or some judges to some form of popular election. In all but four such states, judges, encouraged and supported by their fellow lawyers in the organized bar—would-be judges and beneficiaries of judicial power—have responded by adopting codes of judicial ethics that limit what candidates for election to judicial office are permitted to say. The effect is to undermine elections as a control on judicial power by limiting criticism of judicial activism, the misuse of judicial power. (shrink)

In the post-1945 world, constitutionalism has transcended the nation state, with an array of transnational arrangements now manifesting constitutional characteristics—so says a growing number of scholars. This article reveals an earlier but largely forgotten discourse of transnational constitutionalism: the constitutional theory of the British Empire in the late 19th and early 20th centuries. Focusing on the work of Albert Venn Dicey, the article shows that, when the Empire was at the height of its power and prestige, British constitutional scholars came (...) to see the Empire as a constitutional order and project. For Dicey, a committed constitutionalist and imperialist, the central dynamic of the imperial constitutional order was balancing British constitutional principles with imperial unity. This article focuses in particular on parliamentary sovereignty, a constitutional principle that, for Dicey, was both necessary for and dangerous to the Empire’s integrity. An exercise in intellectual history, the article rethinks Dicey’s work and the constitutional tradition in which Dicey has played such an integral part, seeking to reveal empire's forgotten significance. This paper provides a discussion of Jacques Rancière’s former teacher at École Normale Supérieure, then famous for fashioning Marxism with the philosophical gauge of structuralism, Louis Althusser. Perhaps a brief discussion on the relation between the two would render context to the origins of Rancière's philosophico-political praxis, specifically the humble beginnings of conceptualizing an egalitarian method out of his philosophical rupture with Althusserianism. Meanwhile, to reduce the philosophical enterprise of Althusser into its practical shortcomings and silence during the revolutionary events (...) of May 1968 in France would do an injustice to the magnitude of his contribution to contemporary French political theory and his major revisions in the theoretical direction of the Parti communiste français. Thus, the following discussions focus on sketching Althusser's theoretical foundations, which possibly clarifies the political decision he has made during May '68: a demand for organization over spontaneous revolutionary activity based on the authority of theoretical practice over the ideological activities—a decision that became the point of departure for Rancière's subversion of both mastery and the structural inequality Althusserianism entail. The whole piece is guided by the following two-fold question—a question, perhaps, akin to Badiou's inquiry: What were the philosophico-political interventions of Louis Althusser, and why did Rancière move away from his direction? International law lacks many of the standard features of domestic law. There are few legislative or judicial bodies with exclusive authority over particular jurisdictions or subject matters, the subjects regulated by international law typically must affirmatively consent to be bound by it, and supranational authorities with the power to coerce states to comply with international obligations are rare. How can a legal system with these features generate changes in state behavior? For many theories, the ability of international law to inform (...) and change individual preferences provides the answer. When voters care that treaty commitments be kept, or that international norms be honored, the theory goes, leaders are more likely to be able to make choices consistent with international obligations. Over the last decade, a literature has emerged testing these theories using surveys and experiments embedded in surveys. Multiple U.S. studies find that international law and international norm arguments shift public opinion in the direction of greater compliance by 4 to 20 percentage points. However, studies in foreign contexts are more mixed, with some backlash reported in countries in which international law is highly politicized. This Article describes the state of current knowledge about whether international law actually does change preferences, explains the limitations with existing research, and proposes avenues for future study. Industrial (“white”) biotechnology promises to contribute to a more sustainable future. Compared to current production processes, cases have been identified where industrial biotechnology can decrease the amount of energy and raw materials used to make products and also reduce the amount of emissions and waste produced during production. However, switching from products based on chemical production processes and fossil fuels towards “biobased” products is at present not necessarily economically viable. This is especially true for bulk products, for example ethanol production (...) from biomass. Therefore, scientists are also turning to genetic modification as a means to develop organisms that can produce at lower costs. These include not only micro-organisms, but also organisms used in agriculture for food and feed.The use of genetic modification for “deliberate release” purposes, in particular, has met great opposition in Europe. Many industrial biotechnology applications may, due to their scale, entail deliberate releases of GM organisms. Thus, the biobased economy brings back a familiar question; is it ethically justifiable, and acceptable to citizens, to expose the environment and society to the risks associated with GM, in order to protect that same environment and to sustain our affluent way of life? For a successful innovation towards a biobased economy, its proponents, especially producers, need to take into account (take responsibility for) such issues when developing new products and processes. These issues, and how scientists can interact with citizens about them in a timely way, are further explored in projects at Delft University and Leiden University, also in collaboration with Utrecht University. Two systems of belief change based on paraconsistent logics are introduced in this article by means of AGM-like postulates. The first one, AGMp, is defined over any paraconsistent logic which extends classical logic such that the law of excluded middle holds w.r.t. the paraconsistent negation. The second one, AGMo , is specifically designed for paraconsistent logics known as Logics of Formal Inconsistency (LFIs), which have a formal consistency operator that allows to recover all the classical inferences. Besides the three usual (...) operations over belief sets, namely expansion, contraction and revision (which is obtained from contraction by the Levi identity), the underlying paraconsistent logic allows us to define additional operations involving (non-explosive) contradictions. Thus, it is defined external revision (which is obtained from contraction by the reverse Levi identity), consolidation and semi-revision, all of them over belief sets. It is worth noting that the latter operations, introduced by S. Hansson, involve the temporary acceptance of contradictory beliefs, and so they were originally defined only for belief bases. Unlike to previous proposals in the literature, only defined for specific paraconsistent logics, the present approach can be applied to a general class of paraconsistent logics which are supraclassical, thus preserving the spirit of AGM. Moreover, representation theorems w.r.t. constructions based on selection functions are obtained for all the operations. (shrink)

While the concept of adaptive preferences is an important tool for criticizing injustice, it is often claimed that using the concept involves showing disrespect for persons judged to have adaptive preferences. In this paper, I propose an account of adaptive preferences that does the relevant political work while still showing persons two centrally important kinds of respect. My account is based in what I call an indirect substantive account of autonomy, which places substantive requirements on the options available to a (...) person, rather than on the option that she ultimately prefers. This allows us to pinpoint cases in which a person's circumstances have rendered her insufficiently autonomous, without saying that any conception of the good must be non-autonomous tout court. Tras descartar el acercamiento metodológico a la historia de Doñana como un paso hacia la “conservación de la Naturaleza” con mayúscula, este artículo sitúa la historia del Parque en los contextos políticos, personales y científicos que lo hicieron posible. Estos contextos nos colocan en la escala internacional del desmantelamiento del imperio británico y de la transformación de la ornitología y la ecología como disciplinas. Las rutas migratorias de las aves de Doñana contribuyeron a la dimensión internacional en la que se (...) fraguó el acuerdo entre el World Wildlife Fund (WWF) y el Consejo Superior de Investigaciones Científicas (CSIC) que llevó a la inauguración de la Reserva Biológica de Doñana en 1965. La posterior creación del Parque abrió la puerta a nuevos desencuentros entre diversos modos de entender el conservacionismo y entre diferentes categorizaciones científicas del territorio de Doñana. La resolución de estos conflictos dependió de fuerzas y alianzas, lo que permite concluir afinando el argumento metodológico de partida. (shrink)

O objetivo deste artigo consiste em analisar como Nietzsche, baseado na filosofia schopenhauriana, resolveu o problema do surgimento da tragédia grega através da elevação dos elementos Apolo e Dionísio a um estatuto ontológico, e como os gregos fizeram isso em seu tempo através da Música, além de revelar como, em Nietzsche, o pensamento de Sócrates surge como o “perverso algoz da arte”.O estudo foi realizado através de uma pesquisa bibliográfica com base nas seguintes obras do filósofo: A visão Dionisíaca de (...) Mundo e O nascimento da tragédia no espírito da Música. Na segunda parte, sugere-se como Nietzsche faz esse resgate do trágico em sua época e qual a recepção no século XIX de seu trabalho. (shrink)

Hier wird die folgende Frage gestellt: gibt es überhaupt irgendeine unengagierte Philosophie? Nämlich, jede Philosophie, die überhaupt als echte Philosophie bewertbar ist, und nicht etwa als Ideologie, Dophistik oder Schwindel, sollte als Denken, das der Wahrheit treu bleibt, beschrieben werden, d. h. als eine im Dienst der Wahrheit engagierte Philosophie. Dagegen, diejenige Philosophie, die im Dienst einer weltlicher oder jenseitiger Macht antritt, darf man keineswegs als eine Philosophie bewerten. Doch, es wird noch eine Frage gestellt: Wäre es erlaubt, eine Parallele (...) mit der sog. engagierte Kunst zu stellen? Die Antwort wird ermöglicht durch die Definition der Philosophie als die Tätigkeit des unnachsichtigen Dienstes zur Wahrheit. (shrink)

Unter dem Begriff Biologismus verstehen wir die Anwendung strikter wissenschaftlicher biologischer Maßstäbe und Begriffe auf die Gebiete, die nicht durch die Dominanz biologischer Verhältnisse bezeichnet werden. Die Annahme des biologistischen Determinismus resultiert notwendigerweise mit der Auffassung, dass die Kultur durch die biologischen Gesetze determiniert wird. Als Antithese zu einem solchen Reduktionismus stellt sich der Kulturalismus heraus, d. h. die Betonung des Vorrangs kultureller Determinanten im Prozess der Bildung der Kultur und der menschlichen Welt überhaupt. In diesem Beitrag wird bewiesen, dass (...) ein solcher Kulturalismus nur die falsche Alternative zum Biologismus ist. Die menschliche Welt kann auf angemessene Weise nur dann begriffen werden, wenn alle relevanten Dimensionen ihrer Gestaltung in Betracht gezogen werden. Die Voraussetzung dafür ist die Befreiung von allen reduktionistischen Versuchungen. (shrink)
